TOWN OF STAFFORD TOWN BOARD MEETING

JANUARY 8, 2024

 

Supervisor Clement opened the January 8, 2024, Town Board Meeting at 7:52pm with the Pledge of Allegiance. In attendance were Councilman Panek, Councilman Young, Councilman Duyssen, Councilman Pacer, Highway Superintendent Boldt and Town Clerk Radley.

In addition, were attending Cathy Worthington, Andrew Duyssen, Ben Duyssen, and Donna Voorhees.

Councilman Panek made a motion to approve the December 11, 2023, meeting minutes second by Councilman Pacer and approved on a 5-0 vote.

Councilman Panek made a motion to approve the Fire Department Report, second by Councilman Duyssen and approved on a 5-0 vote.

Councilman Pacer made a motion to approve the CEO/ZEO Report, second by Councilman Panek and approved on a 5-0 vote.

Councilman Pacer made a motion to approve the Assessor Report, second by Councilman Young and approved on a 5-0 vote.

The proposal from Lumsden McCormick and Laura Landers was presented for review of our yearly audit. There was no discussion on this matter, and it will be revisited later.

Councilman Panek made a motion due to the current attorney becoming the County Attorney the Town of Stafford hire the Law Firm of DiMatteo, Roach and Kelly to be our Town Attorney, second by Councilman Duyssen and approved on a 5-0 vote.

Supervisor Clement read a letter from The Association of Towns asking the Town of Stafford to review the information and assign a Delegate.  Councilman Panek made a motion to have Councilman Young represent the Town of Stafford, second by Councilman Pacer and approved on a 5-0 vote.

Councilman Pacer made a motion to approve Resolution 6 the Financial Clerical Services Agreement Between the Towns of Batavia and Stafford, second by Councilman Young and approved on a 5-0 vote.

Councilman Panek made a motion to approve Resolution 7 Accepting All information Regarding Water District #12, second by Councilman Pacer and approved on a Roll Call Vote as Follows:

Councilman Duyssen made a motion to approve Resolution 8 Reappointment of William VanAlst to the Planning Board, second by Councilman Pacer and approved on a 5-0 vote.

Councilman Pacer made a motion to approve Resolution 9 Resolution for the Zoning and Code Office to Follow The New York State Zoning and Code Laws, second by Councilman Young and approved on a 5-0 vote.

Councilman Panek made a motion to approve Resolution 10 Resolution Increasing 2023 Budgetary Line Items for Consolidated Local Street and Highway Improvement Program (CHIPS) Pave, NY, Extreme Winter Recovery (EWR), and Pave our Potholes (POP), second by Councilman Duyssen and approved on a 5-0 vote.

Councilman Young made a motion to Approval of Acquisition of an Easement by the Monroe County Water Authority Pursuant to §1096(6-a) of New York’s Public Authorities Law, second by Councilman Pacer and approved on a 5-0 vote.

 

 

Councilman Duyssen made a motion to approve Resolution 12 Accepting the Stafford Volunteer Fire Department Contract for Fire Protection, second by Councilman Panek and approved on a Roll Call Vote as follows:

Supervisor Clement read a letter received from the Stafford Town Court Justice Robert Penepent and Robert Mattice for the Uniform Justice Court Act.

Supervisor Clement reported that a letter was received from the NYSDEC regarding MT Acres using ground water for irrigation purposes. There is a valid permit for this use.

Councilman Panek reported on the tax rates for Genesee County. The Town of Stafford has the fourth lowest tax rate for the County. He also reported on the use of social media for town use. He reported that all the towns now have a website, and they are all like ours. Only two towns have a Facebook page Byron and Alexander, Byron does not allow comments, Alexander does.

Councilman Duyssen made a motion to accept Abstract 13 General Fund in the amount of $22,539.14, second by Councilman Pacer and approved on a 5-0 vote.

Councilman Duyssen made a motion to accept Abstract 13 Highway Fund in the amount of $2,686.19, second by Councilman Pacer and approved on a 5-0 vote.

Councilman Duyssen made a motion to accept Abstract 13 Capital Funds in the amount of $30,572.50, second by Councilman Pacer and approved on a 5-0 vote.

Councilman Duyssen made a motion to accept Abstract 1 General Fund in the amount of $25,786.30, second by Councilman Pacer and approved on a 5-0 vote.

Councilman Duyssen made a motion to accept Abstract 1 Highway Fund in the amount of $25,675.99, second by Councilman Pacer and approved on a 5-0 vote.

A resident from Randall Rd. inquired about a new water district in town. He has poor quality as well as quantity of water at this point. He was advised that next month’s meeting will cover this and was invited to attend that meeting to get further information.

Cathy Worthington asked about the lack of a Financial Report this month. It was explained that we do not have it this month because of the end of the year wrap up. She also asked about the listed banks from the Organizational Meeting; what banks we use and found that the Town of Stafford uses Five Star and NY CLASS. There was a question about who our attorney will be for 2024. The law firm of DiMatteo and Roach will be our attorney.

Councilman Panek made a motion to enter Executive Session at 9:06 PM to discuss possible litigation and invited Highway Superintendent Boldt and Town Clerk Radley were invited, second by Councilman Young and approved on a 5-0 vote.

The regular meeting was resumed at 9:40 PM at that time Councilman Panek made a motion to adjourn, second by Councilman Young and approved on a 5-0 vote.
